Buying a commercial property
 

Buying commercial property as an investment, or buying a business that owns commercial property, can prove very lucrative in a number of ways. When bought with an existing business, commercial property offers the new business owner a tangible, bricks-and-mortar asset to complement the fluid and changing earnings pattern of a going concern, which can help the business buyer to secure the finance needed to make their purchase. When bought as a standalone investment, commercial property can offer the investor the reliable income of a monthly or quarterly rent from a commercial tenant, as well as any gains from the potential increase in the value of the property in a rising market (otherwise known as ‘appreciation’). There are no guarantees that the property can always be rented, or that the building(s) will always appreciate in value, so it’s important to seek professional advice before committing to buy a commercial property. 
 
Commercial property in the UK is categorised using a range of specific planning rules; property is assigned at least one ‘use class’, which determines what kind of business can operate from that premises. To operate a solicitor’s office, for instance, the building must have A2 planning permission, whereas if you want to run a storage warehouse you’ll need B8 planning permission. Each business type tends to have its own specific use class, so if you are thinking of buying a property and running a different kind of business to what’s in the building already, it’s likely you will have to apply to the local authority regarding the change of use.
 
Commercial property can be grouped broadly into two types of ownership: freehold and leasehold. If you buy a “Freehold” property, you own the property outright and the land and buildings, trees etc. on it are 100% yours; you have no service charges or ground rents to pay. If you buy a “Leasehold” property, you are buying the right to rent that property, at an agreed rate, for an agreed term. The rent itself could be very small (sometimes it’s a “peppercorn rent”, where you are obliged to pay 1 peppercorn every year to rent the land), and the terms of the lease / rental agreement can be very long (e.g. 999 years), so in practice, the two ownership statuses can be very similar; it depends on the terms of the lease. If you have any questions about the tenure of a property you wish to buy, the seller will be able to provide you with further information relevant to that particular property.
 
Commercial property can sometimes be bought as part of a personal pension. Seek qualified advice if you are thinking of following this route, as there are a lot of very specific rules that you must follow if you want certain commercial property investments to qualify as part of a SIPP or similar personal pension investment.
